General Terms and Conditions (GTC) for Boat Rental Service

  • Scope and Applicability

1.1 These General Terms and Conditions (GTC) apply to all rental agreements concluded between LuxLife GmbH (“the Company”) and its customers (“the Renter”) regarding the rental of boats provided by the Company.

1.2 By renting a boat from LuxLife GmbH, the Renter agrees to these GTC. Any terms and conditions proposed by the Renter that deviate from these GTC shall only be valid if expressly agreed upon in writing by LuxLife GmbH.

  • Rental Agreement

2.1 The rental agreement is concluded upon the Renter’s acceptance of the offer provided by the Company, either through signing a rental contract or by any other form of acceptance (e.g., online booking).

2.2 LuxLife GmbH reserves the right to refuse a rental without providing a reason.

  • Rental Period

3.1 The rental period is agreed upon in the rental contract. The rental period begins at the time specified for pick-up and ends at the time specified for return.

3.2 Any extension of the rental period requires prior written consent from LuxLife GmbH.

  • Rental Fees and Payment

4.1 The rental fees are as stated in the rental agreement or as listed on the LuxLife GmbH website at the time of booking. Prices include the use of the boat and specified equipment.

4.2 Payment terms are as stated in the rental agreement. Failure to comply with the payment terms may result in cancellation of the reservation.

4.3 A deposit may be required at the time of booking. The deposit will be refunded upon the return of the boat in satisfactory condition.

  • Use of the Boat

5.1 The Renter agrees to use the boat in accordance with the applicable laws and regulations, and to exercise due care and caution at all times.

5.2 The Renter is responsible for ensuring that they, or any person operating the boat, hold a valid boating license if required.

5.3 The boat may only be used within the designated area agreed upon in the rental contract. The boat is not to be used for any illegal activities.

5.4 The Renter is liable for any damage caused to the boat or third parties during the rental period, including damages resulting from negligence or misuse.

  • Insurance

6.1 LuxLife GmbH provides basic insurance coverage for the boat. However, the Renter is responsible for any deductible amounts in case of damage or loss.

6.2 The Renter is advised to obtain additional insurance coverage if needed, particularly if engaging in high-risk activities.

  • Cancellation and Changes

7.1 Cancellations made by the Renter must be communicated in writing. The cancellation fees are as follows:

  • More than 30 days before the rental period: full refund.
  • 15-30 days before the rental period: 50% of the rental fee.
  • Less than 15 days before the rental period: no refund.

7.2 LuxLife GmbH reserves the right to cancel the rental agreement if the boat becomes unavailable due to unforeseen circumstances. In such cases, the Renter will receive a full refund.

  • Liability

8.1 LuxLife GmbH is not liable for any injuries or damages suffered by the Renter or third parties during the rental period, unless caused by gross negligence or intentional misconduct by the Company.

8.2 The Renter indemnifies LuxLife GmbH against any claims made by third parties as a result of the Renter’s use of the boat.

  • Return of the Boat

9.1 The boat must be returned at the agreed-upon time and location. The boat should be in the same condition as when it was rented, excluding normal wear and tear.

9.2 If the boat is returned late, additional rental fees may apply. LuxLife GmbH reserves the right to charge the Renter for any losses incurred due to the late return.

  • Data Protection

10.1 LuxLife GmbH processes personal data in accordance with the applicable data protection laws. Personal data provided by the Renter will be used solely for the purpose of fulfilling the rental agreement.

  • Governing Law and Jurisdiction

11.1 These GTC and the rental agreement are governed by the laws of Switzerland.

11.2 Any disputes arising out of or in connection with these GTC or the rental agreement shall be subject to the exclusive jurisdiction of the courts of St. Gallen, Switzerland.

  • Miscellaneous

12.1 If any provision of these GTC is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.2 Any amendments or modifications to these GTC must be made in writing and signed by both parties.
